Agreement to Terms
By downloading, installing, or using Extinct ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
Extinct is a mobile application designed to help users break unwanted habits through proven extinction techniques. The App provides:
- Habit tracking and monitoring tools
- Urge resistance timers and tracking
- Progress visualization and insights
- Replacement behavior suggestions and tracking
- Mindful break exercises and guided practices
- Reward systems and progress celebrations
Eligibility
You must be at least 13 years old to use Extinct. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.
User Responsibilities
You agree to:
- Use the App only for lawful purposes and in accordance with these Terms
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App in any way that could damage, disable, or impair the App
- Not use automated systems or bots to access the App
- Maintain the security of your device and any data stored on it
- Use the App responsibly and not rely solely on it for medical or therapeutic advice
Subscription Services
Premium Subscription
Extinct offers a premium subscription service that provides access to additional features, including:
- Unlimited habit tracking
- Advanced insights and analytics
- Full access to mindful break exercises
- Custom replacement behaviors
Subscription Plans
We offer the following subscription options:
- Monthly Plan: Billed monthly at the price displayed in the App
- Yearly Plan: Billed annually at the price displayed in the App, includes a 14-day free trial
Free Trial
The yearly subscription includes a 14-day free trial period. You will not be charged until the trial period ends. You can cancel at any time during the trial period to avoid being charged.
Billing and Payment
All subscriptions are processed through Apple's App Store using StoreKit. By purchasing a subscription, you agree to:
- Pay all charges associated with your subscription
- Provide accurate payment information
- Authorize Apple to charge your payment method
- Accept that subscription fees are non-refundable except as required by law
Automatic Renewal
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation
You can cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period, and you will continue to have access to premium features until that time.
Refunds
Refund requests are handled by Apple in accordance with Apple's refund policy. We do not process refunds directly. If you believe you are entitled to a refund, please contact Apple Support.
Intellectual Property
The App, including its original content, features, and functionality, is owned by Extinct and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written permission.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that the App will help you break habits or achieve any specific results.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXTINCT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR $50, WHICHEVER IS GREATER.

Extinct is not a medical or therapeutic service. The App is intended for informational and self-help purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or addiction.
If you are experiencing a medical emergency, please call emergency services immediately.
Data and Privacy
Your use of the App is also governed by our Privacy Policy. All data is stored locally on your device, and we do not collect, store, or transmit your personal information. Please review our Privacy Policy to understand our data practices.
Termination
We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms.
You may stop using the App at any time by uninstalling it from your device.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Extinct operates, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between you and Extinct regarding the use of the App and supersede all prior agreements and understandings.
